These Terms of Service (“Terms”) govern your access to and use of Podrecast (“Service”). By using the Service, you agree to these Terms.

1. Description of Service

Podrecast is a software platform that converts user-provided podcast content (including audio files such as MP3s and transcripts) into AI-generated social media content and images.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.

3. User Content & Rights

3.1 Ownership.You retain ownership of any content you submit (“User Content”).

3.2 License to Us. You grant Podrecast a limited, non-exclusive license to process, store, and transform your content solely to provide the Service.

3.3 Responsibility for Content. You represent and warrant that:

  • You own or have the necessary rights to upload and use any content you submit (including audio files such as MP3s)
  • Your content does not infringe any third-party rights, including copyright

Podrecast does not verify ownership of content.

3.4 Content Removal. If you believe content infringes your rights, contact us at [email protected]. We may remove content at our discretion.

4. AI-Generated Content

Content generated by the Service is produced by AI models and may be inaccurate, incomplete, or unsuitable.

We do not guarantee originality, accuracy, or legal safety of outputs.

You are solely responsible for reviewing and verifying content before use or publication. Podrecast is not responsible for how generated content is used.

5. Beta & Availability

The Service may still contain experimental or evolving features.

We do not guarantee uninterrupted, secure, or error-free operation.

Features may change or be removed at any time.

6. Credits, Billing & Payments

6.1 Credits. The Service uses a credit-based system for content generation. Credits may be provided for free or purchased.

6.2 Billing. Payments are processed via Stripe.

6.3 Refunds. Credits are non-refundable except where required by law.

6.4 Usage. Credits are deducted only upon successful generation.

6.5 Subscriptions. If you purchase a subscription:

  • It renews automatically unless canceled
  • You can manage or cancel via the billing portal

7. Acceptable Use

You agree not to:

  • Use the Service for unlawful or harmful purposes
  • Upload content you do not have rights to
  • Generate misleading, abusive, or infringing material
  • Interfere with or disrupt the Service

8. Data & Retention

We store your submitted content and generated outputs to operate the Service.

We may delete, anonymize, or modify data at any time, especially during early-stage operation.

9. Privacy

Your use of the Service is also governed by our Privacy Policy.

10. Termination

We may suspend or terminate your access at any time for any reason, including violation of these Terms.

11. Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind.

12. Limitation of Liability

To the maximum extent permitted by law, Podrecast shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service.

13. Governing Law

These Terms are governed by the laws of Washington, USA, without regard to conflict of laws principles.

14. Changes to Terms

We may update these Terms at any time. Continued use of the Service constitutes acceptance of updated Terms.
